As of 26 December 2025 I have started to record all phone calls made from/to my phone. This page will guide you through the retention period and storage of said phone calls.

Disclaimer: You acknowledge that I will advise you during the phone call that it will be recorded and you will be given the opportunity to opt out during the phone call by ceasing the call. If you do not cease the call you agree that you have given “consent” and a verbal contract has taken place between you and I for the duration of the phone call and recording retention period listed below.1, 2, 3, 4, 5

  • Personal: 7 days2. — unless special circumstances occur
  • Work: 90 days2 — unless special circumstances occur.

Special Circumstances Retention Period

  • You have committed an offense against the state or territory you live in or against the country and/or national assets. — 2 years5.
  • For legal protection of a potential breach of work contract either as an employer or employee - for HR/Workplace investigation purposes — 7 years3.

How Data Is Kept & Laws I Comply With

The data is stored locally on a mobile device with encryption plus safeguards such as pin scrambling and copy protection by disabling the USB C port for data transfer with radios GPS/Wi-Fi/mobile data turned-off or disabled when not required — in use.

If the device storage needs to be freed up then the recordings will be moved to a zero knowledge E2EE service which the host provider can not access, distribute or copy files as they do not hold the encryption keys.

  • Telecommunications (Interception and Access) Act 19791: applies nationally and prohibits recording without consent, even if state laws permit it, meaning this federal law overrides inconsistent state regulations.
  • Privacy Act 19882: recordings be retained only as long as needed, stored securely and not disclosed to anyone unless required by law.
  • Fair Work Act 20093: requires 7 years for employment-related recordings.
  • Surveillance Devices Act 20164: South Australian state law requires consent from all parties involved on phone call however superseded by above federal law.
  • Criminal Procedure Act 19215: all states and territories have different time frames however my home state of SA has a criminal charge period of 2 years unless a major offense such as sexual assault, or other charges carrying maximum penalties of more than two years imprisonment.
